Tracing The Evolution of APD’s “Culture Of Aggression” Ends With A Warning

The Keller Administration and the Albuquerque Police Department (APD) intends to spend $88 million dollars, over the next four-year period, with 32 million dollars of recurring expenditures, to hire 322 sworn officers and expand APD from 878 sworn police officers to 1,200 officers. The 2018-2019 fiscal year budget provides for increasing funding from 1,000 sworn police to 1,040. The massive investment is being done in order to full fill Mayor Tim Keller’s 2017 campaign promise to increase the size of APD and return to community-based policing as a means of reducing the city’s high crime rates.

The APD recruiting plan to grow the size of the department includes the city increasing police officer hourly pay and increasing longevity pay. APD is projecting that it will have 980 officers by next summer by growing the ranks with both new cadets, lateral hires from other departments, and returning to work APD retirees. APD has recruited 59 sworn police officers as “lateral hires” from other law enforcement agencies in the State of New Mexico. In October, APD graduated a lateral academy with 29 officers. 10 previously retired APD officers have been recruited to return to work. 2 retirees from other law enforcement departments have recruited to return to work. On December 20, 2018, the APD Academy graduated 42 police officers with 32 of those officers who will work for APD with the other 10 going to work for other law enforcement agencies. APD officials believe they are on track to hire 100 officers by June 30, 2019, the end of the fiscal year.

DEPARTMENT OF JUSTICE CONSENT DECREE

Albuquerque is one of 18 law enforcement agencies throughout the country operating under a consent decree brought on by a Department of Justice (DOJ) investigation that found systemic problems and a “culture of aggression”. What differentiates the DOJ’s investigation of APD from all the other federal investigations and consent decrees is the fact that the others involve in one form or another the finding of “racial profiling” and use of excessive force. The DOJ’s finding of a “culture of aggression” within APD dealt with APD’s interactions and responses to suspects that were mentally ill.

In APD’s case, the DOJ found a “culture of aggression” within APD after reviewing as many as 18 “deadly use of force cases” and other cases of “excessive use of force” mostly with the mentally ill and having nothing to do with racial profiling. The City of Albuquerque has paid out $61 million in settlements over the last 9 years involving 41 police officer involved shootings.

The implementation of reforms under the federal Court Approved Settlement Agreement (CASA) began in 2014 after a Department of Justice (DOJ) investigation found a “pattern and practice of excessive force” and a “culture of aggression” within the Albuquerque Police Department (APD). It was 2012 when the Department of Justice (DOJ) came to Albuquerque to investigate the Albuquerque Police Department (APD) for excessive use of force and deadly forced.

Many in the community and some within APD and at the APD Police Academy proclaimed that there was a “relaxing of hiring standards” from 2005 to 2009 that resulted in the “culture of aggression” and use of excessive force and deadly force. There was a civil lawsuit filed for excessive use of force that identified one cadet class that had a disportionate number of police officers involved with “excessive use of force” or “deadly force cases” with the argument made that there was a reduction in hiring standards and people were hired that should not have been hired.

Some within APD asserted and that there was duress or unacceptable pressure to lower standards and hire unqualified people by then Mayor Martin Chavez, which is false.

COMMENTARY AND ANALYSIS

Proclaiming that there was a relaxing of hiring standards that created APD’s “culture of aggression” is far too easy and ignores what really happened and what I witnessed. The truth is no Mayor can order the relaxing of hiring standards for law enforcement. By law a Mayor is strictly prohibited from getting involved with the personnel rules and regulations and hiring when it comes to classified protected positions as are rank and file law enforcement personnel.

If there was a relaxing of hiring practices, it was the APD upper command staff and the Police Academy personnel that was responsible. Former Mayor Martin Chavez did not order any cop be hired but he did demand that APD get the number of sworn police officers up which was the Police Academy’s job. Orders to get the numbers up of rank and file is something all Mayors do, including Jim Baca, Richard Berry and now Tim Keller not to mention the City Council.

There was a full 8 years of very bad management of APD by former Mayor Berry, who kept APD Chief Ray Schultz during his entire first term as Mayor. In 2010, APD was fully staffed at 1,100 sworn police and arguably it was the best trained and best equipped police department in the City’s history and crime rates were down.

From 2010 to 2017, the number of sworn police dropped from 1,100 to 878. When Schultz retired at the end of Berry’s first term in 2013, Berry appointed political operative APD Chief Gorden Eden who had absolutely no prior experience managing a municipal police department.

APD Chief Goron Eden then created the position of “Assistant Chief” and hired his political loyalist and former SWAT Commander Robert Huntsman who had retired a few years before from APD. Assistant Chief Huntsman was the commander in charge of the SWAT Unit that was involved with a number of the “deadly use of force” cases investigated by the DOJ.

Notwithstanding the Berry administration negotiating the federal Court Approved Settlement Agreement (CASA), they never were fully committed to the Department of Justice reforms. For a full three years, the Berry Administration and APD under the leadership of Chief Eden and Assistant Chief Huntsman did whatever they could to “delay”, “deflect”, “subvert”, and use “covert orders”, all words used by the federal monitor, to undermine all the reforms under the consent decree.

It was Assistant Chief Huntsman who secretly recorded contentious meetings between police officials and the federal monitor and the City Attorney proceeded to file a Motion to have Dr. Ginger removed as the Federal Monitor alleging he was biased. Assistant Chief Huntsman was involved with reviewing and rewriting many “use of force” and “deadly for policies” he was responsible enforcing when he was SWAT commander calling into serious question his real commitment to the DOJ reforms.

THE EVOLUTION OF THE CULTURE OF AGGRESSION

The beginning of “the culture of aggression” can be traced back to 2005 when 3 law enforcement personnel and 3 civilians were murdered. In August, 2005, APD Officers Richard Smith and Michael King and civilians David Fisher (age 17), Garrett Iverson, (age 26) and Ben Lopez were all killed the same day by mentally ill John Hyde.

Police Officers Smith and King were dispatched to take John Hyde into custody, but they did not know his was mentally ill and violent nor of the fact that he had killed 3 civilians earlier that day. When the 5 murders occurred, then APD Chief Police Ray Schutz proclaimed very loud and clear that the killing of cops would “never happen on his watch” again. A few months later Bernalillo County Sheriff’s Deputy James Mcgrane was killed during a traffic stop by a violent felon with priors.

The 6 killings had a profound and lasting impact on APD and the New Mexico law enforcement community in general. The pronouncement by then Chief Schultz that the killing of cops would never happen on his watch ever again signaled in reality APD’s abandonment of community-based policing. After the killings, the number one priority of APD and the APD Police Academy became “police officer safety”.

More training in officer safety and defense tactics to respond to escalating and violent confrontations was provided by the police academy and training was also provided by the US Department of Homeland Security. More reliance was given by APD to call out the SWAT unit. Soon after the killing of BCSO Deputy Sheriff James McGrane, his family established the “McGrane Institute” that provides “Officer Street Survival Training” every year to law enforcement with the use of private donations.

It was in 2010 that violent crimes and property crimes began to spike dramatically over 8 years in Albuquerque which also contributed to further need for more training in “officer street survival” training. In 8 years, Albuquerque’s violent crime and property crime rates became more than triple the national crime rates.

In 2016 and again in 2017, New Mexico had the country’s highest per capita rate of property crime and the second-highest per capita rate of violent crime. In 2017, the number of violent crimes in the specific categories of murder, rape, robbery and aggravated assault, in Albuquerque increased even though the City’s population remained essentially the same.

In 2017, Albuquerque had a record high of 75 homicides reported. On December 20, 2018, Albuquerque had 65 homicides reported for 2018. From 2005 to 2011, all under the leadership of former APD Chief Ray Schultz, was when the militarization of APD happened with the hiring and training more cops including many laterals and the securing of military surplus equipment to arm the police department.

A major byproduct of the change in training and an increase in violent crime mandating self-defense was a far more aggressive police department. De-escalation training tactics and crisis intervention with the mentally ill took a major backseat to officer safety tactics after the 2005 murders of the 3 law enforcement personnel.

For a full 10 years, APD gave priority and further preference as required by federal law to the hiring of ex-military. A heavy reliance on APD SWAT became all too common from 2010 to 2013 rather than the use of de-escalation tactics and crisis intervention.

It was from 2010 to 2014, under Mayor Berry’s and Chiefs Ray Shultz and Gordon Eden’s watch, that there were 18 APD police officer-involved shootings, many of them fatal involving the APD SWAT Unit, that brought the DOJ in to investigate APD for use of excessive force and deadly force. A dramatic game changer occurred in March, 2014 when two APD SWAT officers shot and killed mentally ill homeless camper James Boyd armed with knives in the Sandia Foothills.

The two SWAT Officers who killed Boyd were later charged with murder, but were not convicted and not acquitted with the trial ending with a deadlock jury and the District Attorney dismissing the charges. The Boyd family was paid $5 million by the City to settle the civil lawsuit for wrongful death and civil rights violations

A WARNING OF CAUTION

There are a few major warnings that can be derived from tracing the root causes of APD’s “culture of aggression” that need to be taken seriously by Mayor Tim Keller and APD Chief Michael Geier.

In the last six months APD has recruited and has hired a total of 71 experienced police officers consisting of 59 lateral hires and 12 return to work retired hires which can be directly attributed to the dramatic increase in hourly pay and lucrative “incentive pay” bonuses and APD’s aggressive recruiting program. At this point, APD needs to concentrate on recruiting a new generation of young, committed police officers to begin their careers who are fully trained in constitutional policing practices.

Keller and Geier are hiring and returning to work APD retirees which does have a significant advantage in hiring experienced police officers, but there are also disadvantages in hiring police officers far too set in their ways. The biggest danger with APD returning retirees to work is hiring back police officers and returning to work people who may have created, knew or who contributed to or who did not stop the culture of aggression found by the DOJ.

The biggest danger in hiring laterals is the hiring of a generation of police officers who may not be fully committed to constitutional policing practices and hiring “problem” officers that have left their former agencies for personal reasons unknown to APD and only motivated by lucrative pay rather than a bigger commitment to law enforcement and public service. APD needs to curb its efforts of hiring retirees and lateral hires and concentrate now on hiring younger new generation of police officer to begin their law enforcement career and to rebuild APD from the ground up.

Increases in police officer shooting of suspects tend to ebb and flow over a period of years. In 4 to 6 years after growing APD from 857 to 1,200 sworn police, it is hoped the city will have a police force fully trained and committed to constitutional policing with officer involved shootings very few and far between and with no settlement payouts in the millions of dollars.

Otherwise, the city and APD may just wind up having yet another cycle of a “culture of aggression”.

According to the news sources a total of 10 cabinet members are “sponsors” of the White House bible study group.The White House bible study sessions last between 60 and 90 minutes. The leader of the White House bible study group is Ralph Drollinger, a pastor and president of Capitol Ministries, an organization which aims to “evangelize elected officials and lead them toward maturity in Christ.”

Drollinger has sparked controversy in the past for his views on women, Catholicism and opposition to same-sex relationships. Arguing that women and men have “different roles,” Drollinger claimed in a BBC News interview:

“There is a prohibition of female leadership in marriage, and female leadership in the church. And those are clear in Scripture… it doesn’t mean, in an egalitarian sense, that a woman is of lesser importance.”

Drollinger has also said:

“Homosexuality and same-sex ceremonies are illegitimate in God’s eyes. His word is repetitive, perspicuous [clearly expressed], and staid on the subject.”

Confidential sources have provided a detailed listing of the “Trump Ten Commandments” discussed during the weekly White House Bible Study meetings. The Trump Ten Commandments are reported to be:

1st TRUMP COMMANDMENT: Thou shall have no other Gods before Trump.

The one and only person allowed to teach this Bible Study course is Trump himself because he believes he is God. Trump’s book “The Art of the Deal” is used as the bible in the course. Attendees have a hard time reading their autograph copies because all the pages are stuck together with smears of the “special sauce” from McDonalds used on Big Macs.

2nd TRUMP COMMANDMENT: Thou Shall Not Make False Idols That Are Not Trump.

All White House staff must carry 3-inch gold sprayed painted plastic statue of Trump with “small hands” that they are required to worship each day. No other idols are allowed in the White House. Rudy Giuliani has led this Bible study on this commandment for a small fee of $5,000 per hour with the money “funneled through” the Michael Cohen’s former law firm account. While Giuliani lectures, Trump himself stands in front of the mirror saying prayers to himself while eating McDonald’s cheese burgers in the private quarters, all the while FOX News blares in the background on TV.

3rd TRUMP COMMANDMENT: Thou Shall Not Take The Name Of Lord Trump Your God In Vain.

Former Secretary of State Rex Tillerson use to teach this class until he was fired by Trump while Trump sat on a toilet because Tillerson referred to Trump as a “f…ing moron”. Chief of Staff John Kelly took over the class until he called Trump an “idiot” and Kelly has also left the White House. Like Chief of Staff, Trump is having a hard time finding anyone who works for him to teach this class who has not called him an idiot or a moron.

4th TRUMP COMMANDMENT: Remember the Sabbath Day, To Keep It Holy, Unless Every Day Is The Trump Sabbath.

This Bible study class has been cancelled until further notice from the President in that in his mind every day at the White House is the sabbath day to worship Donald Trump.

5th TRUMP COMMANDMENT: Thou Shall Honor Your Father Trump and Your Step Mother.

Eric Trump, Ivanka Trump and Donald Trump Jr. are all trying to teach First Lady Melania Trump this commandment. Melania is said to keep citing quotes from old notebooks from all former Mrs. Trumps.

6th TRUMP COMMANDMENT: Thou Shall Not Kill, Unless You Are President Trump.

This Trump Commandment has its origins from when Trump said “I could stand in the middle of Fifth Avenue and shoot somebody and I wouldn’t lose any voters.” Michael Cohen, the president’s fixer, use to teach this commandment taking “anyone out” Trump wanted, until Cohen was indicted, plead guilty and sentenced to 3 years in jail for lying to congress. President of the National Rifle Association Wayne La Pierre offers a substitute class for credit entitled “People Kill People, Not Assault Rifles”.

7th TRUMP COMMANDMENT: Thou Shall Not Commit Adultery, Unless You Have A Really Good Prenuptial.

Stormy Daniels teaches this commandment class using over 5,000 rough drafts of confidentiality agreements Trump has used to settle all his extra marital affairs. Stormy Daniels is said to use a pole teaching the class as she spins around answering any and all questions as she sings “I Got You Babe”.

8th TRUMP COMMANDMENT: Thou Shall Not Steal And Not Say It Is A Campaign Donation.

Paul Manafort, Trump’s former campaign manager, was teaching this class until he was thrown in jail after being tried and convicted of federal crimes but he is trying to offer televised classes from federal prison. As a backup, the White House has asked over 3,000 students of Trump University to teach this commandment. However, there are no takers with all awaiting refunds from the settlement in the fraud lawsuit filed against Trump.

9th TRUMP COMMANDMENT: Thou Shall Not Lie, But Make Sure You Do You Lie When You Get Caught.

Former Presidential fixer Michael Cohen and former National Security Advisor Michael Flynn use to teach this class. The only ones that are now allowed to teach this class are Russian President Vladimir Putin, Sarah Huckabee Sanders and Kellyanne Conway. Former National Security Advisor Michael Flynn was scheduled to teach this class, but he cancelled after his sentencing in Federal Court on charges that he lied to the FBI were delayed. Special Counsel Robert Mueller has subpoenaed all the course materials.

10th TRUMP COMMANDMENT: Thou Shall Not Covet What Is Trump’s.

Kim Jong-Un and President Donald Trump are trying decide who will lead this study class as they await word who gets the “Nobel Peace Prize”. Two awards have already been cast in radioactive “yellow cake” by the Nobel Peace Prize Committee, one in the shape of “LITTLE BOY” and the other in the shape of “FATMAN”, the nicknames given to the two atomic bombs dropped on Hiroshima and Nagasaki, Japan at the end World War II.

The Nobel Prize committee is said to be conflicted as to who gets the “FAT MAN” trophy and who gets the “LITTLE MAN” trophy calling it the closest call they have ever had in recent history making the awards. The Nobel Committee is hoping to take the measurements of Kim’s and Trump’s hands and wastes as tie breakers.

Never Make A Promise You Do Not Intend To Keep

The story involves the child abuse case brought against two adults alleging crimes against their 7-year-old for prostitution, human trafficking, and criminal sexual contact of a minor.

The case is being prosecuted by the New Mexico Attorney General’s Office.

This is the case where the bloody underwear of a 7 year old girl was not collected and tag into evidence by APD.

Initially Chief Gieir and Mayor Tim Keller said APD policy was followed.

The Attorney General Office is now saying it was left in the dark during a police internal affairs investigation into the child abuse case, potentially affecting the prosecution of the defendant charged with forcing the 7-year-old girl to work as a prostitute.

The New Mexico Attorney General’s office has notified by letter Albuquerque City Attorney Esteban Aguilar that strict discovery deadlines in the 2nd Judicial District Court could be affected by the Albuquerque Police Department’s interviews with witnesses in the case and the failure to provide the defense with the transcripts.

The Attorney General’s in May asked that it be included if police interviewed the witnesses during the internal affairs investigation.

The only communication between the city and the AG’s office about the internal affairs investigation was Wednesday of last week in a letter in which the AG’s office questioned why it wasn’t notified that the internal affairs investigation had been finished.

APD Chief Michael Geier disciplined five officers after reviewing investigations by the Civilian Police Oversight Agency (CPOA) and APD’s Internal Affairs Bureau.

Last summer, Mayor Tim Keller backtracked big time on his assertion that APD policy had been followed, order an APD Internal Affairs Investigation, met with the Journal editors and announced new policy changes with the handling of evidence in child abuse cases.

Keller promised that the internal affairs investigation would be publicly released after it was completed.

It never was.

Last week, the Journal asked the city for a copy of the internal affairs investigation that led to the disciplinary action.

An APD police spokesman said the city was waiting on guidance from the Attorney General’s Office about whether the investigation could be released, even though APD proceeded with interviews without telling the Attorney General’s office.

These are the very type of stories that tend to destroy the credibility of APD and Mayor Tim Keller’s promise to be transparent.

Political Satire And Parody Pure Essence Of Free Speech

On December 17, 2018, President Donald Trump once again went to war against “Saturday Night Live” (SNL).

Trump is apparently threatening to sue the show after it aired a segment imagining a world in which he was never elected.

The sketch was a parody of “It’s a Wonderful Life,” the holiday James Stewart classic film, where a man wishes he were dead and an angel appears and grants his wish and he is shown what the world would be like if he never had lived.

The SNL parody features key figures from in and outside the Trump administration gloating about how much better their lives are without a Donald Trump presidency.

Michael Cohen, the presidents “fixer”, played by Ben Stiller, who was sentenced to 3 years in federal prison for acting on his orders to pay women hush money during the 2016 election, isn’t going to prison in the skit.

Press Secretary Sarah Huckabee Sanders is making a lucrative living in public relations.

Presidential advisor Kellyanne Conway is on speaking terms with her husband who has been highly critical of Trump lately.

Newly approved Supreme Court Justice Brett Kavanaugh, played by Matt Damon, gloats about how he’s free to talk about beer without coming off as physically threatening.

Special Counsel Robert Mueller, played by Robert DeNiro, gets to spend more time with his grandson instead of “investigating the president for treason.”

In a Sunday morning “tweet” Trump had this to say:

“A REAL scandal is the one sided coverage, hour by hour, of networks like NBC & Democrat spin machines like Saturday Night Live. It is all nothing less than unfair news coverage and Dem commercials. Should be tested in courts, can’t be legal? Only defame & belittle! Collusion?”

COMMENTARY AND ANALYSIS

Throughout his entire life, and especially when running for President, Trump has been litigious and hostile toward the media.

President Trump promotes hostility, mistrust and violence towards the press as well as his critics with his own words and actions.

Trump has often derided the media as “fake news,” even labeling reporters as “enemy of the people”.

A few months ago, Trump told his supporters at one of his pre-2018 mid-term rallies:

“I just cannot state strongly enough how totally dishonest much of the Media is. Truth doesn’t matter to them, they only have their hatred & agenda. This includes fake books, which come out about me all the time, always anonymous sources, and are pure fiction. Enemy of the People!”

Trump has never had a problem making fun of and ridiculing people in public.

When he was running for President, he mocked and made fun of all his opponents with nicknames such as “lyin Ted”, “low energy Jeb”, “little Marco”, “Pocahontas” and the ever so popular “crooked Hillary”.

Trump has made fun of woman about their weight and facial looks and called women he does not like “fat pigs”, “dogs”, “slobs”, and “disgusting animals”, has referred to “blood running out of places” of women when talking about a female newscaster.

When he was running for President, Trump went so far as to shake and move his arms around like he had a neurological disorder to mimic and make fun of a reporter who did have such a disorder and who was asking Trump tough questions.

After seeing the skit on Saturday Night Live, there is no doubt it will be an instant classic to be repeated over and over again.

Throughout the entire history of this country, political parody, political satire and political cartoons have been protected free speech.

Political satire and humor is the most effective way of really cutting through all the Trump rhetoric and lies, especially when it is based on some elements of fact in the news.

As President Harry Truman once said, “If you cannot stand the heat get out of the kitchen.”

Many are hoping that Special Counsel Robert Mueller will be turning up the heat hot enough for Mr. Trump to leave the White House, the sooner the better.

Frankly, I can not wait for the SNL parody of the Donald Trump Senate Impeachment hearings that will be unfolding sooner rather than later now that the Democrats have the majority in the House of Representatives.

Kushner, who is already an official White House adviser, already has met with President Trump about the job.

According to media outlets, Kushner has been pushing his own candidacy with Trump, citing his work on a criminal justice reform package and a claimed ability to work with Democrats.

Trump is scrambling to find another Chief of Staff, considered one of the most powerful positions in the White House.

Nick Ayers, the Chief of Staff to Vice President Mike Pence, was seen as the frontrunner to replace Trump’s departing Chief of Staff John Kelly, until he withdrew from consideration.

Others that were said to being considered are Office of Management and Budget director Mick Mulvaney, Rep. Mark Meadows, a North Carolina Republican and the chairman of the House Freedom Caucus, Treasury Secretary Steve Mnuchin, U.S. Trade Representative Robert Lighthizer and former New Jersey Governor Chris Christie who ran for President against Trump.

There is no doubt that if Trump appoints Jared Kushner Chief of Staff it would be in violation of the federal nepotism statute, but that does not matter because of the way the law is written.

Following is the statute:

5 U.S. Code § 3110 – Employment of relatives; restrictions

(a)For the purpose of this section—

(1)“agency” means—

(A) an Executive agency;

(B)an office, agency, or other establishment in the legislative branch;

(C)an office, agency, or other establishment in the judicial branch; and

(D)the government of the District of Columbia;

(2) “public official” means an officer (including the President and a Member of Congress), a member of the uniformed service, an employee and any other individual, in whom is vested the authority by law, rule, or regulation, or to whom the authority has been delegated, to appoint, employ, promote, or advance individuals, or to recommend individuals for appointment, employment, promotion, or advancement in connection with employment in an agency; and

(3) “relative” means, with respect to a public official, an individual who is related to the public official as father, mother, son, daughter, brother, sister, uncle, aunt, first cousin, nephew, niece, husband, wife, father-in-law, mother-in-law, son-in-law, daughter-in-law, brother-in-law, sister-in-law, stepfather, stepmother, stepson, stepdaughter, stepbrother, stepsister, half brother, or half sister.

(b) A public official may not appoint, employ, promote, advance, or advocate for appointment, employment, promotion, or advancement, in or to a civilian position in the agency in which he is serving or over which he exercises jurisdiction or control any individual who is a relative of the public official. An individual may not be appointed, employed, promoted, or advanced in or to a civilian position in an agency if such appointment, employment, promotion, or advancement has been advocated by a public official, serving in or exercising jurisdiction or control over the agency, who is a relative of the individual.

(c) An individual appointed, employed, promoted, or advanced in violation of this section is not entitled to pay, and money may not be paid from the Treasury as pay to an individual so appointed, employed, promoted, or advanced.

(d) The Office of Personnel Management may prescribe regulations authorizing the temporary employment, in the event of emergencies resulting from natural disasters or similar unforeseen events or circumstances, of individuals whose employment would otherwise be prohibited by this section.

(e) This section shall not be construed to prohibit the appointment of an individual who is a preference eligible in any case in which the passing over of that individual on a certificate of eligibles furnished under section 3317(a) of this title will result in the selection for appointment of an individual.

The position of Chief of Staff does not have to be approved like cabinet secretaries with advise and consent of the United States Senate which means that Trump could go ahead with the appointment.

The problem with the statute is the penalty for violating it contains no criminal penalty.

According to section 3 (C) if Trump makes the appointment of Jared Kushner as Chief of staff the only penalty would be is that Kushner would not be paid, but he would have the enormous power within the White House.

Kushner is a millionaire, does not need to be paid, and is no doubt more interested in the power.

COMMENTARY AND ANALYSIS

Article II, Section 4 of the United States Constitution provides that “The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.”

The power and authority to bring Articles of Impeachment rests solely with the United States House of Representatives and a trial is then conducted by the United State Senate for removal from office, unless of course there is a resignation like Richard Nixon.

A “high crime and misdemeanor” can be whatever the House of Representatives say it is in Articles of Impeachment.

However, being an idiot or a moron is not a high crime or misdemeanor, because if it were, well, let’s not go there.

Violating the provisions of the nepotism statute could easily be defined as an impeachable offense.

The biggest problem for Trump at this point is finding anyone within his own administration who is actually loyal to him, who does not think he is a “f…ing moron” as expressed by former Secretary of State Rex Tillerson or an “idiot” as expressed by John Kelly in private, and who does not think he has any business being President.

The appointment of Kushner would undermine the intent and spirit of the law but that has never mattered to Trump.

Jared Kushner and Trumps daughter Ivanka Trump may be the only two in the White House that Trump can trust at this point, but that still does not mean that they do not think he is a moron or an idiot.

It’s kinda like saying, I love my father, drunk or sober, moron or idiot.

City: “Go Play On The Freeway and ART Bus Platforms”

On December 12, 2018, the Keller Administration announced it wants to make use of the unused ART Bus lanes and platforms on Central until new buses arrive.

There are 20 empty or unused ART platform bus stations along the 9-mile Central Ave route, all with electric utilities, including neon lighting and police monitors with adjoining dedicated bus lanes.

It could be another 18 months before new diesel-fueled ART buses from manufacturer New Flyer are manufactured, delivered and running full service along the 9-mile Central Avenue ART Bus route.

The newly ordered New Flyer buses have a base price of $870,000, which is $500,000 less than the original electric buses.

CITY PROPOSES TEMPORARY ALTERNATIVE USE FOR THE PLATFORMS

The city will not allow use of the dedicated ART Bus lanes for regular traffic.

Mayor Tim Keller proclaims that even while there’s no bus movement in the ART lanes, it is still illegal to drive in them by crossing the double white lines and rumble strips.

Instead, Mayor Keller announced he wants to open the tens of millions of dollars of ART Bus infrastructure to local businesses, artists and anyone who wants to apply for a temporary permit for an event.

Permits to locate a “small pop-up business” at any one of the bus stops is also being considered.

According to ABQ Ride Public Information Officer Rick De Reyes:

“Marathons, 5 or 10K runs, for getting music and bands on the platforms, maybe to pop up events for businesses and even art shows, things like that [can be considered] … They’re trying to find a way to be able to block off the street in such a way that some cars can run on Central or that there will be detours … “

According to a Municipal Development spokesman, the city would assist to protect those hosting and attending events.

Safety barricades, security personnel or an Albuquerque Police Department presence is being suggested.

The city would also work to alert and educate drivers passing by the festivities.

The Department of Municipal Development is working out the permitting process, including the cost and how the city might redirect traffic for these proposed events and pop-ups.

The city is hoping to have events and pop-ups by springtime.

It’s also looking at issuing temporary permits to businesses along Central so they can load and unload merchandise from the ART lanes.

COMMENTARY AND ANALYSIS

Growing up, I often heard parents say “Do not play in the middle of the street!”

This recent proposal of using the ART Bus platforms makes it appear that the Keller Administration wants us all to go play in the middle of the street.

At first blush, from a civil liability standpoint, it does not sound too bright using public mass transportation infrastructure in the very middle of the street for private businesses and functions, especially when the city says it will provide safety barricades, security personnel or an Albuquerque Police Officer.

Central is congested enough as it is with the bus stations, and added functions or businesses to them is nothing more than a lawsuit ready to happen, just ask any personal injury lawyer in the city.

Once the city assists to protect those hosting and attending events on the city owned and maintained platforms it is assuming an extent of liability if and when someone gets hurt.

Allowing unloading activities on dedicated bus lanes is probably just as illegal as to drive in them by crossing the double white lines and rumble strips as Keller argues.

Mayor Keller needs to cut our losses as best he can and scrap ART as much as he can wherever he can and business pop ups is not a solution, temporary as it may be.

The City has already completed and paid for all the construction and it will never recoup the estimated $110 million paid out, but would be wise not to spend another $25 million for the new buses ordered.

Mayor Keller has said that too much has been spent on the entire ART Bus project and it would be too costly to restore Central and to remove the platforms.

Keller has repeatedly suggested in public it would cost as much as $200 million to return Central to the way it was, a figure that is highly questionable, especially given the fact that it will eventually have to happen anyway.

What Keller apparently does not know or just chooses to ignore is that a traffic study of the project found that the project has a 20-year shelf life.

Because of projected population growth and traffic flows along Central, one lane each way, as opposed to the original two, the platforms will sooner rather than later have to be removed to accommodate the increased traffic.

Within 12 years the buses will have to be replaced.

In general, transit systems expect buses to have a useful life of 12 years or a little less depending on wear and tear and 250,000 miles.

The 12-year time frame is due to the fact that after buses have been used for 12 years, a city is eligible to receive replacement bus funding from the federal government.

Common sense dictates that the dedicated buses lanes for ART should be opened up for all traffic use and not any other function.

City Hall needs to rededicate the bus lanes for all traffic and do its best to restore Route 66.

The Keller Administration should explore if the center bus platform stops can be modified permanently with a totally new purpose and a permanent alternative found.

The platforms have utilities installed that could be used for other purposes.

Tearing down the ART Bus stop platforms would have too much of another negative impact on Route 66 businesses, and so will allowing “pop up” businesses to compete with Central store front businesses and parking.

Examples of new dedicated purposes for the platforms could be elevated landscaping with distinctive lighting fixtures or use the platforms for large sculptures that would commemorate Route 66.

Mayor Keller proclaimed the BYD Buses as unsafe at any speed but apparently feels it’s alright and safe to play in the middle of the street.
